2019 MUNICIPAL ELECTION -April 2, 2019

Qualifying begins Monday, February 4, 2019 at 9:00 am

and ends at 12:00 pm on Friday, February 8, 2019

Sec. 10-1. - Nomination and election of mayor and members of town council; petition; acceptance;

(a)Election method. The mayor and councilmembers shall be chosen by plurality vote of the electors casting their ballots.

(b)Nomination by petition. Candidates for the office of mayor and town councilmember in each election shall be nominated on a nonpartisan basis by petition. There shall be no primary caucus or mass meeting for such purpose. Each petition supporting the candidacy of a person for office of either mayor or councilmember shall:

(1)Be filed with the town clerk during the time for qualifying set forth in subsection (d) of this section;

(2)Contain the name of each candidate; and

(3)Specify as to each candidate which office that candidate is being nominated for, viz., the office of mayor or the office of councilmember, as the case may be, and that such person possesses the qualifications required for the office which he seeks.

A petition shall contain a minimum of five signatures of town residents eligible to vote at the election at which the candidate is proposed for election. Each elector may subscribe to only one nomination for each of the places to be filled.

(c)Acceptance of nomination. A person whose name has been submitted for candidacy by petition shall file with the town clerk a written acceptance within the time for qualifying set forth in subsection (d) of this section, which shall state that, if elected, the person nominated will qualify and serve in such office during the term for which he is elected. It shall be the duty of the town clerk with whom such acceptance is filed to forthwith make and deliver to such candidate a written receipt acknowledging such acceptance and stating the date of its filing. If any candidate shall fail to timely file such acceptance, his/her name shall not appear upon the ballot.

(d)Time for qualifying. A person who has accepted a nomination for candidacy shall qualify as a candidate during the regular office hours of the town clerk during the period commencing the first Monday in February at 9:00 a.m. and ending on the Friday following the first Monday in February at 12:00 noon, local time, preceding the next town election.

(e)Requirements for qualification. The mayor and councilmembers shall have been, at the time of qualifying, both a bona fide, continuous and uninterrupted resident and elector of the Town of Lake Hamilton for at least one (1) year prior to qualifying.

At the time of qualifying, candidates shall be required to submit proof satisfactory to the town clerk that they have met the requirements of this section. If satisfactory proof is not submitted prior to the end of the qualifying period, the town clerk shall not qualify that person for the office sought and their name shall not appear on the ballot. Satisfactory proof of having met the residency requirements of this section and F.S. § 114.01, shall include submission of the following applicable items for the one-year period prior to qualifying: homestead exemption documentation, residential property lease, utility bills which reflect usage of utilities at a level indicating actual residence, and Florida driver's license and/or identification card. Candidates may also submit to the clerk any other documentation that shows them to be a bona fide resident at their qualifying address. Candidates must also submit documentation that they have been a registered elector as required by this section for the one-year period prior to qualifying. As a condition of qualifying, all candidates must sign a release authorizing the town clerk to verify the information that they have submitted.
